Process After a DWI Arrest in Dallas

According to a study done by Patterson Personal Injury, 23.2% of Texans confess that they have driven while under the influence at some time in their life. Of that 23.2%, 34.4% admit to driving impaired within the past year.

If you’re one of those drivers and cause an accident or get stopped by the police, you’ll soon discover how stressful a DWI arrest can be. As a generally law-abiding citizen, ending the night behind bars probably never crosses your mind. This means you probably also don’t know what comes next which makes the situation even scarier.

That’s why today Delta Bail Bonds is going to share all of the information you need to know about the arrest process after you’re charged with a DWI in Texas.

Getting Arrested for a DWI

One night you’re driving home after a great night catching up with your friends. It feels like any other night– your head is just a little fuzzy. You think that everything is going great until you notice a car with the telltale red and blue flashing lights pulling up behind you.

You pull over to the side of the road and an officer approaches your window. He shines his flashlight into your vehicle and asks, “Have you had anything to drink?”

The cop asks you to step out of the car so he can perform a sobriety test. Even if you’re sober, these tests can get your adrenaline pumping and make you fumble. Still, it’s best to stay calm, respectful, and compliant.

If you fail the field sobriety test or a breathalyzer test and are arrested, the officer will bring you to the station where they will check your BAC, or blood alcohol concentration. If it is over the legal limit of 0.08%, you will be arrested and charged with a DWI.

The Amount of Bail for a DWI Arrest

It’s difficult to estimate how high the courts will set bail following a DWI arrest. Ultimately, it will be up to the judge to decide your specific bail amount. Several factors can increase or decrease the bail amount including:

  • Whether or not this is your first DWI offense
  • If you are considered dangerous or a flight risk
  • Previous charges on your criminal record

If the above factors do not apply to you, you can expect bail to be anywhere between $500 – $1,500.

DWI Penalties in Dallas

For first-time offenders, DWI penalties may look like the following:

  • A fine of up to $2,000
  • Driver’s license suspension
  • Additional fees up to $1,000 annually for the first three years to get your driver’s license

The fees listed above would be added to any bail bond costs, attorney fees, and any other charges you acquire. Note that for second-time offenders, fines double. Third-time offenders will experience more severe penalties.
